Damage & Rental Agreement

Business Name: Topsail Beach Gear
Service: Beach Chair & Shibumi Shade Rentals

By reserving or using rental equipment from Topsail Beach Gear, you agree to the terms below.

1. Rental Responsibility

All rental items remain the property of Topsail Beach Gear at all times.

The renter is responsible for all rented items from the time of delivery until pickup. This includes proper use, care, and safekeeping of the equipment during the rental period.

2. Proper Use of Equipment

Rental equipment is intended for normal beach use only.

The renter agrees to:

  • Use equipment only for its intended purpose

  • Not leave items unattended on the beach overnight

  • Follow all local beach rules and regulations

  • Return items in the same general condition as received, normal wear excepted

3. Normal Wear and Tear

Normal wear includes:

  • Sand and salt exposure

  • Minor scuffs from typical beach use

Normal wear does not include:

  • Broken frames or parts

  • Torn fabric or straps

  • Missing components

  • Damage caused by misuse or neglect

4. Damage, Loss, or Theft

The renter is financially responsible for any rental items that are:

  • Lost

  • Stolen

  • Damaged beyond normal wear

If an item is lost, stolen, or damaged, the renter agrees to pay the replacement cost of the item.

Replacement costs may include, but are not limited to:

  • Beach chairs

  • Shibumi Shades

  • Carry bags or accessories

5. Wind & Weather Responsibility

The renter agrees to:

  • Secure or take down equipment during high winds

  • Not leave equipment unattended during unsafe weather conditions

Damage caused by improper use during high winds or storms is the renter’s responsibility.

6. Delivery & Pickup

Topsail Beach Gear provides delivery and pickup as part of the rental service.

The renter agrees to:

  • Provide accurate delivery information

  • Leave rental items in the agreed-upon location at checkout

Failure to leave items accessible for pickup may result in additional charges.

7. Changes, Cancellations & Early Returns

If travel plans change, renters should contact us as soon as possible.

Refunds or credits are not guaranteed once delivery has occurred. Early returns do not qualify for partial refunds.

8. Limitation of Liability

Topsail Beach Gear is not responsible for:

  • Injuries resulting from use of rental equipment

  • Personal items lost or damaged while using rental equipment

  • Weather-related conditions affecting beach use

Use of rental equipment is at the renter’s own risk.

9. Agreement Acceptance

By completing a reservation, the renter confirms that they:

  • Have read and understood this agreement

  • Agree to all terms and conditions

  • Accept responsibility for rental items during the rental period
